Reassessing Consumer Contract Formation and Execution in Autonomous and AI-Driven Contexts

This article proposes a hybrid computational legal analysis of consumer contract formation and execution in AI-driven contexts, treating Moroccan Law 31-08 and Law 09-08 as doctrinal foundations and computational legal methods as the primary analytical engine. The central research question is: how can defeasible logic and algorithmic compliance modeling operationalize consumer protection obligations in AI-mediated contractual environments? The study addresses three interlocking challenges: the validity of AI-mediated consent under conditions of algorithmic opacity, the legal recognition of personal data as contractual consideration, and the operationalization of the professional duty of conformity for autonomous and evolving AI products. The article introduces defeasible logic rule-sets (IC-1, DC-1, CF-1), two computational compliance models (the Algorithmic Consent Validation Engine (ACVE) model and the Automated Conformity Assessment Model (ACAM)), figures depicting model architecture and knowledge structures, and a multi-scenario simulation applied to a representative AI-driven e-commerce platform. The methodological contribution lies in making explicit how computational techniques complement and extend doctrinal analysis by offering scalability, auditability, and reproducibility in digital consumer protection enforcement. Comparative benchmarks are drawn from the EU AI Act, OECD AI Principles, and European Law Institute model rules on digital assistants. The article concludes with targeted recommendations for Moroccan legislative reform and RegTech implementation.
